These Terms govern photography services provided by Carms Enterprise LLC and your use of this website. By booking a session or completing checkout, you agree to them.
Bookings
- A booking request is not confirmed until we send written confirmation by email.
- A 25% retainer holds your date. The remaining balance is due before final delivery.
- Prices are in U.S. dollars. Florida sales tax of 7% is applied at checkout where applicable. Add-ons are quoted before they are charged.
- Sessions begin at the scheduled time; late arrivals may shorten the session.
Cancellation and refunds
Cancellations, reschedules, and refunds are covered by our Refund & Cancellation Policy, which forms part of these Terms.
Client responsibilities
- Provide accurate contact details, access to the location, and any required permits.
- Obtain consent from anyone who will appear in the photographs.
- Ensure the shoot location is safe for our team and equipment.
Copyright and licensing
We retain copyright in all images. On full payment you receive a non-exclusive, perpetual license to use delivered images for your own marketing, website, and social channels. Reselling, sublicensing, or distributing the images as stock requires our written permission. Please do not crop out or alter credited watermarks where they are part of the agreed deliverable.
Portfolio use
We may request permission to show your images in our portfolio. You can decline or withdraw that permission at any time by emailing us.
Delivery
Standard delivery is two weeks from the session date unless a different timeline is agreed in writing. Galleries remain available for download for 90 days; archive retrieval after that may incur a fee.
Limitation of liability
To the fullest extent permitted by Florida law, our total liability for any claim relating to a session is limited to the amount you paid for that session. We are not liable for indirect or consequential losses. Nothing in these Terms limits rights that cannot be limited by law.
Force majeure
If a session cannot proceed due to events outside our reasonable control, such as severe weather, illness, or equipment failure, we will reschedule at the earliest mutually available date at no additional fee.
Governing law
These Terms are governed by the laws of the State of Florida, and disputes will be handled in the state or federal courts located in Broward County, Florida.
